Terms of Service

Agreement

These Terms of Service govern your access to and use of DMVWebAgency and the website design, build, hosting, and maintenance services we provide. By submitting an inquiry, subscribing, or using our services, you agree to these Terms. If you do not agree, do not use our services.

The service

DMVWebAgency designs, builds, hosts, and maintains your website for a flat subscription of $249 per month. Work begins after you submit an inquiry; ongoing service — hosting, edits, and maintenance — continues only while your subscription is active. Any timelines we share (such as preview turnaround) are estimates, not guarantees.

Billing & renewal

Subscriptions are billed monthly in advance through Stripe and renew automatically until cancelled. By subscribing you authorize us, through Stripe, to charge your payment method on each renewal. There are no setup fees. You are responsible for keeping your payment details current.

Price changes

We may change our subscription pricing at any time. For existing subscribers, a price change takes effect on your next renewal after we give reasonable advance notice (for example, by email). If you do not accept a new price, you may cancel before it takes effect.

Cancellation & refunds

You can cancel anytime. When you cancel, your service continues through the end of the current paid period, after which billing stops and your site is taken offline. Payments are non-refundable, including for partial months or unused time.

Non-payment & suspension

If a payment fails or your account becomes past due, we may suspend or take your site offline and may terminate the service. We are not responsible for any loss resulting from suspension or takedown due to non-payment.

Your content & responsibilities

You are responsible for the text, images, logos, and other materials you provide ("Your Content") and for ensuring you have the rights to use them. You grant us a non-exclusive license to use, store, reproduce, modify, and display Your Content as needed to build, host, and maintain your site. You represent that Your Content is lawful and does not infringe anyone's rights, and you are responsible for the accuracy of information shown on your site.

Acceptable use

You may not use our services for any unlawful, infringing, deceptive, or harmful purpose. We may refuse, remove, or decline to publish content, or decline to provide services, at our discretion.

Ownership & intellectual property

The website we design, build, and host — including its design, code, structure, and configuration — is the property of DMVWebAgency and is licensed to you for use only while your subscription is active. Your domain and Your Content remain yours. If you cancel or the service ends, your site is taken offline; we are not obligated to transfer, hand over, export, or otherwise provide the website, its code, or its design. We retain all rights to our underlying tools, templates, components, and know-how, and may reuse them for other clients.

No guarantees

We do not guarantee any specific results, including search-engine rankings, traffic, leads, revenue, or uninterrupted, error-free availability. Hosting relies on third-party providers and may experience downtime.

Disclaimer

Our services are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, DMVWebAgency will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. Our total liability for any claim relating to the services will not exceed the amount you paid us in the three (3) months before the event giving rise to the claim.

Indemnification

You agree to indemnify and hold DMVWebAgency harmless from any claims, damages, or expenses (including reasonable legal fees) arising from Your Content or from your use of the services in breach of these Terms.

Termination

We may suspend or terminate the services at any time, including for breach of these Terms or for non-payment. Upon termination for any reason, your right to use the site ends and the site is taken offline. Provisions that by their nature should survive (such as ownership, disclaimers, limitation of liability, and indemnification) will survive termination.

Changes to these terms

We may update these Terms from time to time. Material changes are reflected by updating the "Last updated" date above; your continued use of the services after changes take effect constitutes acceptance.

Governing law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. Any disputes are subject to the exclusive jurisdiction of the state and federal courts located in Virginia.

Privacy

Your use of our services is also governed by our Privacy Policy.
