Terms of Service

Agreement

These Terms of Service govern your access to and use of DMVWebAgency and the website design, build, hosting, and maintenance services we provide. By submitting an inquiry, engaging us for a project, or using our services, you agree to these Terms. If you do not agree, do not use our services.

The service

DMVWebAgency designs and builds custom websites. Each project is custom, so the fee is quoted to you before work begins. Work starts after you submit an inquiry and accept your quote; when the project is complete, the finished website is yours. Optional hosting and maintenance with us is available and quoted per project. Any timelines we share (such as preview turnaround) are estimates, not guarantees.

Fees & payment

Your project fee is quoted in advance and payable as agreed in your quote. Payments are processed through Stripe. If you arrange ongoing hosting or maintenance with us, those fees are quoted separately and you are responsible for keeping your payment details current for as long as that arrangement continues.

Quotes & changes

Quotes are valid for the period stated on the quote. If the scope of a project changes materially after work begins, we may re-quote the additional work before proceeding. Any ongoing hosting or maintenance arrangement may be re-quoted with reasonable advance notice (for example, by email).

Cancellation & refunds

Either party may end an engagement as set out in the quote. Payments for work already completed are non-refundable. If you end an ongoing hosting arrangement with us — or we do — we hand over your complete website so you can host it wherever you like; it's yours.

Non-payment & suspension

If a payment for hosting or maintenance fails or becomes past due, we may suspend those services until the balance is settled. Suspension of hosting does not affect your ownership of your website. We are not responsible for any loss resulting from suspension due to non-payment.

Your content & responsibilities

You are responsible for the text, images, logos, and other materials you provide ("Your Content") and for ensuring you have the rights to use them. You grant us a non-exclusive license to use, store, reproduce, modify, and display Your Content as needed to build, host, and maintain your site. You represent that Your Content is lawful and does not infringe anyone's rights, and you are responsible for the accuracy of information shown on your site.

Acceptable use

You may not use our services for any unlawful, infringing, deceptive, or harmful purpose. We may refuse, remove, or decline to publish content, or decline to provide services, at our discretion.

Ownership & intellectual property

Upon final payment for your project, the finished website — including its design, code, structure, and configuration — belongs to you, along with your domain and Your Content. There is no transfer fee: you may host the site with us or take it and host it anywhere you like, at any time. We retain rights only in our pre-existing tools, libraries, components, and know-how, which we may reuse for other clients, and we may showcase the work in our portfolio unless you ask us not to.

No guarantees

We do not guarantee any specific results, including search-engine rankings, traffic, leads, revenue, or uninterrupted, error-free availability. Hosting relies on third-party providers and may experience downtime.

Disclaimer

Our services are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, DMVWebAgency will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. Our total liability for any claim relating to the services will not exceed the amount you paid us in the three (3) months before the event giving rise to the claim.

Indemnification

You agree to indemnify and hold DMVWebAgency harmless from any claims, damages, or expenses (including reasonable legal fees) arising from Your Content or from your use of the services in breach of these Terms.

Termination

We may suspend or terminate the services at any time, including for breach of these Terms or for non-payment. Termination of hosting or maintenance does not affect your ownership of your website — we hand over the complete site so you can host it elsewhere. Provisions that by their nature should survive (such as ownership, disclaimers, limitation of liability, and indemnification) will survive termination.

Changes to these terms

We may update these Terms from time to time. Material changes are reflected by updating the "Last updated" date above; your continued use of the services after changes take effect constitutes acceptance.

Governing law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. Any disputes are subject to the exclusive jurisdiction of the state and federal courts located in Virginia.

Privacy

Your use of our services is also governed by our Privacy Policy.
